Welcome to Marczo. These Terms and Conditions ("Terms") govern your access to and use of Marczo's NFC smart business card products, digital profile services, website, and upcoming mobile applications (collectively, the "Service").

By accessing or using Marczo, you agree to these Terms. If you do not agree, please discontinue use immediately.

2. Eligibility

To use the Service, you must:

  • Be at least 18 years old
  • Provide accurate registration information
  • Have the legal authority to represent yourself or an organisation

Use of Marczo is prohibited where it violates local laws.

3. Account Responsibilities

You agree to:

  • Maintain accurate account and profile information
  • Keep login credentials confidential
  • Immediately notify us of unauthorized use

We may suspend or remove accounts involved in fraud, abuse, or violations of these Terms.

4. Service Description

Marczo provides:

  • NFC smart business cards
  • A digital networking and business profile platform
  • Lead collection and profile sharing functionality
  • Digital platform access via web and upcoming mobile app

We may update features or discontinue any part of the service at any time.

5. User Content

You are responsible for all information you upload including text, images, logos and business details.

You must not upload harmful, illegal, offensive or misleading content.

We may remove content that violates these Terms.

6. Business Profile Data & Lead Data

  • You control the profile information you publish through your Marczo business profile.
  • Lead contact information submitted by others who tap your card belongs to you.
  • Marczo does not use or sell lead data collected by users.

You must handle leads ethically and in line with applicable regional privacy laws.

7. Advertising & Consent

With explicit consent during signup, Marczo may use your business profile information for:

  • Internal and external advertising
  • Personalized or generic promotional campaigns
  • Business discovery and partner opportunities

You may opt-out of advertising at any time by contacting [email protected].

Lead contact data is never used for advertising.

8. Payments

  • All product and service payments must be completed at checkout.
  • Prices may vary by region and may change with notice.
  • Taxes and currency conversion fees may apply depending on location.

9. Intellectual Property

All platform content, design, and software are owned by Marczo or its licensors.

Users may not copy, reproduce, distribute, reverse-engineer, or exploit the service.

10. Third-Party Services

We may work with third-party providers including:

  • Supabase (cloud storage & database)
  • Payment processors
  • Analytics tools
  • SMS/email service providers
  • Shipping carriers

Use of such services is subject to their respective terms.

11. Service Availability

We may modify, suspend, or discontinue any part of Marczo without liability.

We do not guarantee uninterrupted access and are not liable for outages or performance delays.

12. Limitation of Liability

Marczo is not liable for:

  • Lost business, revenue, leads, or opportunities
  • Misuse of user profile data presented publicly
  • Damages from improper handling or loss of NFC cards
  • Unauthorized access resulting from user negligence

To the extent permitted by law, Marczo's total liability will not exceed the amount paid by you in the previous 12 months.

13. Termination

We may suspend or terminate accounts for violations of these Terms or suspected fraud.

Users may request account deletion by emailing [email protected].

Refund & Shipping Policy

14. Refund Policy

  • Custom NFC cards cannot be refunded once printed, as they are personalized products.
  • For defective or damaged items upon arrival, you must notify us within 7 days of delivery.

Refund/Replacement claim requires:

  • Original packaging
  • Unboxing video clearly showing the damage or defect

Non-Refundable

  • Printed NFC cards (customized design)
  • Change-of-mind or preference-based returns
  • Digital services after activation

Digital Platform Refunds

Digital services and subscription features are non-refundable once activated, regardless of usage.

15. Replacement Policy

If a product is confirmed as damaged, defective, or lost:

  • We may provide a replacement after verification with the shipping provider.
  • Replacement approval is not guaranteed unless the issue is validated.

16. Shipping Policy

Shipping Regions

  • We ship both within India and internationally.
  • Delivery times vary based on country and logistics conditions.

Shipping Charges

  • Within India: shipping charges are included in the product price.
  • International shipping: charges are calculated at checkout based on region and courier rates.

Return Shipping

Return shipping may vary depending on the customer's location. We will provide instructions and address details if return is approved.

17. Lost or Damaged Shipments

If required by law or supported by carrier investigation, we will send a replacement once the shipping provider confirms damage or loss.

18. Governing Law

These Terms are governed by:

  • Indian law & DPDP Act 2023 for Indian users
  • Applicable international laws for international users

Any disputes will be resolved in the courts of Bengaluru, Karnataka, India.

19. Changes to Terms

We may update these Terms at any time. Continued use of Marczo constitutes acceptance of the updated version.
